Cell Phone Policy

California Phone-Free Schools Act (AB 3216)

Background

In response to growing concerns about the impact of mobile phone use on student mental health, academic engagement, and campus culture, California lawmakers passed the Phone-Free Schools Act (AB 3216) in 2024. Signed by Governor Gavin Newsom, the legislation strengthens existing education code by requiring public schools to implement comprehensive policies limiting or prohibiting student use of mobile phones during the school day.

The law is grounded in data and research linking increased screen time to rising rates of anxiety, depression, and classroom distraction. It reflects a statewide commitment to prioritizing student well-being and creating learning environments that foster focus, connection, and inclusion.

Community Outreach

Leading up to the law’s implementation in the 2025–2026 school year, the district engaged in robust community outreach to ensure our policy reflects the needs of our students, families, and staff. Feedback was gathered through:

  • Superintendent’s Student and Parent Advisory Committees

  • Survey for students, staff, and parents/guardians

  • Staff meetings

This process helped shape a districtwide approach that balances the intent of the law with students’ access to learning tools, communication, and safety. You can view the results of the survey presented at the June 10, 2025 Board Meeting.

Our Policy

Beginning in the 2025–2026 school year, both Los Gatos and Saratoga High Schools will implement a new Phone-Free Policy. Key components include:

  • Students will not be permitted to use personal mobile phones during instructional time, unless authorized by a teacher or listed in their IEP/504 plan.

  • Each school site will provide secure options for students to store phones during class time.

  • Families are encouraged to communicate with students through the main office during the school day in case of emergencies.

  • Accommodations will be made for students with specific needs as outlined in IEPs or 504 plans.

We believe this policy will support our broader goals of enhancing student focus, improving social interaction, and promoting healthier learning environments across all campuses.
